1. ACCEPTANCE OF TERMS

1.1. GoRocky Medical Inc. (referred to as “GoRocky”, "Company," "We," "Us," or "Our") provides telehealth services, including medical consultations, prescriptions, and related healthcare products through the GoRocky and GoSlim platforms (collectively, the "Service").

1.2. By using the Service, you agree to abide by these Terms and Conditions. If you do not accept these terms, do not create an account or use the Service.

1.3. We reserve the right to modify or update these Terms at any time. Any changes will be posted on our platform, and your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

2. YOUR ACCOUNT

2.1. Eligibility: You must be at least 18 years old or have reached the age of majority in your jurisdiction to use the Service.

2.2. Account Registration: To use certain services, you must register an account with GoRocky. You are responsible for maintaining the confidentiality of your login information and for any activity under your account.

2.3. False Information: If we discover that you have provided false or misleading information, we reserve the right to suspend or terminate your account without liability.

3. MEDICAL SERVICES AND CONSULTATIONS

3.1. Telehealth Services: Through our platform, users can consult with licensed medical professionals. These consultations are subject to medical availability and your location in the Philippines.

3.2. No Doctor-Patient Relationship with GoRocky: By using our platform, you acknowledge that GoRocky is not a healthcare provider. Instead, you are entering into a healthcare provider-patient relationship directly with the medical professionals who offer services through the platform.

3.3. Prescription: Prescription medications will only be dispensed after a consultation with a licensed healthcare provider who has determined that the prescribed medication is appropriate for you.

3.4. Risks: While telehealth services offer convenience, there are risks, including technical failures, delays, and security breaches, which you acknowledge by using the platform.

4. PAYMENTS AND REFUNDS

4.1. Payment: Payment for consultations, prescriptions, and products must be made via our secure payment gateway. Prices are subject to change, and any such changes will be reflected on the platform.

4.2. Refunds: Refunds are not available for consultations or services once confirmed. Refunds may be offered at our discretion in cases of service unavailability or if a prescription cannot be fulfilled.

4.3. Subscription Services: Certain products may be offered on a subscription basis. You may cancel your subscription at any time before the next billing cycle.

5. COMMUNICATION

5.1. Consent to Communication: By using our service, you consent to receive communications from us regarding your health, prescriptions, appointments, and marketing purposes, as outlined in our Privacy Policy.

5.2. Third-Party Communication: You may receive communication from our third-party providers, including pharmacies or medical groups, but only for the purpose of fulfilling our services to you.

6. THIRD-PARTY SERVICES

6.1. External Services: The Service may include links to third-party websites or content. We are not responsible for the accuracy or legality of such third-party services or content.

6.2. No Endorsement: The inclusion of any third-party content or services does not imply endorsement or approval by GoRocky.

7. USER OBLIGATIONS

7.1. You agree not to use the Service for illegal or unauthorized purposes, including posting harmful, defamatory, or unlawful content.

7.2. Prohibited Activities: You may not upload content that violates intellectual property rights or engage in any behavior that disrupts the use of the Service for other users.

8. CANCELLATIONS AND REFUNDS

8.1. Once a consultation or service is confirmed, cancellations initiated by the user are non-refundable.

8.2. If the service cannot be fulfilled, we may offer a refund or alternative arrangements at our discretion.

9. LIMITATION OF LIABILITY

9.1. No Liability for Medical Actions: We are not responsible for any medical decisions made by healthcare professionals via the platform.

9.2. Platform Availability: We make no guarantees regarding the uninterrupted availability or performance of the platform.

10. DISPUTE RESOLUTION

10.1. Arbitration: Any disputes arising under these Terms will be resolved through binding arbitration in accordance with Philippine laws. Arbitration is the exclusive means of resolving disputes, and both parties waive the right to participate in class actions.

10.2. Opt-Out: You may opt-out of arbitration within 30 days of first becoming subject to these Terms by sending a notice to support@gorocky.ph.

11. PRIVACY AND DATA PROTECTION

11.1. Privacy Policy: We respect your privacy and will handle your personal information according to our Privacy Policy. By using the Service, you consent to the collection and use of your personal data in accordance with our policy.

11.2. Health Information: We will use and protect your health information as required by applicable laws, including the Data Privacy Act of 2012 (Republic Act No. 10173).

12. GOVERNING LAW AND JURISDICTION

12.1. Applicable Law: These Terms are governed by the laws of the Philippines.

12.2. Jurisdiction: Any legal action or proceeding related to these Terms will be brought in the appropriate courts located in the Philippines.

13. MISCELLANEOUS

13.1. Entire Agreement: These Terms represent the entire agreement between you and GoRocky.

13.2. Modification of Terms: We reserve the right to modify these Terms at any time. Changes will be posted on the website, and your continued use of the Service will constitute acceptance of the revised Terms.
